Please read this agreement carefully before registering or using the NurseSpark platform. By creating an account, you confirm that you have read, understood, and agreed to all terms stated herein.

1. Ownership & Intellectual Property

All rights reserved — NurseSpark Institute

The NurseSpark platform, including all its content, systems, features, and materials, is the exclusive intellectual property of NurseSpark | Institute of Nursing Education. All rights are reserved under applicable international copyright, trademark, and intellectual property laws.

The following are fully protected and owned by NurseSpark:

  • The NurseSpark name, logo, brand identity, and all associated trademarks
  • The platform architecture, multi-tenant system design, and technical infrastructure
  • All nursing examination questions, answer options, explanations, and feedback content
  • The user interface design, visual layouts, colour schemes, and graphic elements
  • All educational materials, certificates, reports, and analytics outputs generated by the system
  • All underlying source code, algorithms, databases, and API integrations
  • The concept, methodology, and business model of the NurseSpark assessment platform

2. Platform & System Rights

Software, code, and infrastructure

The NurseSpark platform is a proprietary software system developed and maintained by NurseSpark. The system includes, but is not limited to:

  • A multi-tenant nursing MCQ assessment engine serving multiple healthcare institutions
  • An exam security system including fullscreen enforcement, violation detection, dynamic watermarking, and anti-cheating mechanisms
  • An AI-powered feedback engine providing intelligent explanations for incorrect answers
  • A certificate management system with payment gating and verification workflows
  • A live video classroom feature for real-time nursing education delivery
  • Analytics dashboards, leaderboards, gap analysis reports, and member performance tracking tools
  • All backend PHP/MySQL code, database schemas, and server-side logic

No part of this system may be cloned, reverse-engineered, decompiled, or reproduced in any form without prior written authorisation from NurseSpark.

3. Question Bank & Educational Content

MCQs, explanations, and study materials

All multiple-choice questions (MCQs), clinical scenarios, answer rationales, and educational content hosted on NurseSpark have been developed, curated, and reviewed by qualified nursing professionals and subject matter experts. This content is protected under copyright law and is the exclusive property of NurseSpark.

  • Questions may not be copied, photographed, screenshotted, or shared in any form
  • Content may not be used to create or populate competing platforms or question banks
  • Answer rationales and AI-generated feedback are proprietary and may not be republished
  • Study materials, resource files, and documents uploaded by NurseSpark administrators remain the property of NurseSpark or the respective institution

Access to the question bank is granted solely for the purpose of personal learning and assessment within the registered user's institution. Any commercial use is strictly prohibited.

4. Design & User Interface

Visual identity and frontend experience

The visual design, user interface layout, and overall aesthetic of the NurseSpark platform constitute original creative works protected by copyright. This includes:

  • Page layouts, navigation structures, and dashboard designs
  • Colour schemes, typography selections, and gradient styles
  • Icon usage, card designs, and interactive UI components
  • The NurseSpark logo, wordmark, and all brand graphics
  • Email templates, certificate designs, and official communication layouts
  • Mobile-responsive design patterns and PWA (Progressive Web App) implementation

Reproducing, imitating, or substantially replicating any element of the NurseSpark design for any purpose — commercial or otherwise — is prohibited.

5. Prohibited Activities

Actions that are strictly forbidden

The following actions are strictly prohibited and may result in immediate account termination, legal action, or both:

  • Copying, downloading, or distributing any platform content, questions, or materials without written permission
  • Attempting to reverse-engineer, decompile, or access the source code of any part of the NurseSpark system
  • Using automated tools, bots, scrapers, or scripts to extract content from the platform
  • Sharing login credentials, bypassing authentication, or attempting to access another user's account
  • Uploading malicious code, performing penetration testing, or attempting to compromise system security without authorisation
  • Using NurseSpark content to create, train, or populate any competing educational platform or AI system
  • Misrepresenting NurseSpark, its certifications, or its content in any official or public communication
  • Circumventing exam security measures including fullscreen enforcement, anti-cheating systems, or watermarking

Important: Violation of these prohibitions may result in permanent account suspension, civil or criminal legal proceedings, and claims for damages including lost revenue, reputational harm, and costs of enforcement.

6. Data & Privacy

How we handle your information

NurseSpark collects and stores personal data including your name, email address, employee number, profile photo, and usage activity solely for the purpose of providing the platform's educational and assessment services.

  • Personal data is stored securely and is never sold to third parties
  • Data is shared only with your registered institution's administrators for account management purposes
  • Assessment performance data, including exam scores, analytics, and badges, is accessible to your institute's administration
  • You may request deletion of your personal data by contacting your institute administrator or NurseSpark support
  • NurseSpark employs industry-standard security measures including Cloudflare WAF protection, encrypted passwords, and CSRF protection

By registering, you consent to the collection and use of your data as described above in accordance with applicable data protection regulations.

7. User Accounts & Responsibilities

Your obligations as a registered user

As a registered user of NurseSpark, you agree to the following responsibilities:

  • You will provide accurate and truthful information during registration
  • You are solely responsible for maintaining the confidentiality of your password and account credentials
  • You will not share your account with any other individual
  • You will use the platform exclusively for its intended educational purposes
  • You will report any suspected security vulnerabilities or unauthorised access to NurseSpark immediately
  • You acknowledge that your account activity may be monitored and logged for security and quality assurance purposes

NurseSpark reserves the right to suspend or terminate any account found to be in violation of these terms, without prior notice.

8. Enforcement & Legal Action

Consequences of violation

NurseSpark takes the protection of its intellectual property and platform integrity seriously. In the event of a breach of these terms:

  • NurseSpark reserves the right to pursue legal remedies to the fullest extent permitted by law
  • Infringement of copyright may result in claims for statutory or actual damages
  • Violation of system security may be reported to relevant cybercrime authorities
  • Legal proceedings may be initiated in the jurisdiction of Saudi Arabia or the country of residence of the infringing party
  • Users found violating these terms may be liable for all legal costs incurred by NurseSpark in enforcement

Note: All user activity on the platform is logged with timestamps and IP addresses. This data may be used as evidence in any legal proceeding arising from a breach of these terms.

9. Disclaimer

Limitations of liability

The content provided on NurseSpark is intended for educational and professional development purposes only. While every effort is made to ensure accuracy:

  • NurseSpark does not guarantee that all content is free from error or omission
  • Educational content should not be used as a substitute for professional clinical judgment
  • NurseSpark is not liable for any direct, indirect, or consequential damages arising from the use or inability to use the platform
  • NurseSpark reserves the right to modify, suspend, or discontinue any part of the platform at any time without notice
  • These terms may be updated periodically; continued use of the platform constitutes acceptance of the revised terms
